TERMS OF SERVICE
1. About Reelality Media
Reelality Media provides video production, photography, drone videography, podcast production, content creation, editing, creative consultation, and related media services for businesses, organisations, individuals, and public bodies.
By booking a service, accepting a quote, paying a deposit, or confirming a project in writing, the client agrees to these Terms of Service.
2. Quotes and Project Scope
All quotes provided by Reelality Media are based on the information available at the time of quoting. A quote may include some or all of the following:
Pre-production and creative planning
Filming or photography time
Drone operation, where applicable
Editing and post-production
Sound, music, graphics, colour correction, subtitles, or social media cutdowns
Delivery of agreed final files
Any work outside the agreed scope may be quoted separately. This may include additional shoot days, extra edits, additional deliverables, travel, accommodation, stock footage/music, voiceover, advanced graphics, urgent turnaround, or significant changes to the original brief.
3. Booking and Deposit
A booking is only confirmed once the client has accepted the quote and paid the agreed deposit.
Unless otherwise agreed in writing, a 35% deposit is required to secure a booking. This deposit reserves production time, planning time, and availability.
The remaining balance is due according to the payment terms stated on the invoice or quote.
4. Payment Terms
Invoices must be paid by the due date stated on the invoice.
Final files may be withheld until payment has been received in full, unless otherwise agreed in writing.
Late payment may result in delayed delivery, suspension of work, or additional administrative charges where appropriate.
5. Cancellations and Rescheduling
If a client needs to cancel or reschedule a confirmed booking, they must notify Reelality Media as soon as possible.
Deposits may be non-refundable where production time, planning time, crew, equipment, travel, or other resources have already been allocated.
Where possible, Reelality Media will try to reschedule the booking to a suitable alternative date. If a project is cancelled at short notice, Reelality Media may charge for work already completed, costs already incurred, and time reserved for the project.
For consumer clients, Irish consumer protection rules may apply, including rights around contracts, cancellations, and services purchased online, over the phone, or away from business premises. Citizens Information notes that consumers may have cancellation rights for certain distance contracts, and the Consumer Rights Act 2022 introduced rights for services bought by consumers.
6. Weather, Access, and Unforeseen Circumstances
Some productions may depend on weather, access, location availability, permissions, or safe operating conditions.
Reelality Media reserves the right to reschedule, adapt, or postpone work where conditions make filming unsafe or impractical. This includes, but is not limited to, heavy rain, high winds, unsafe drone conditions, illness, equipment failure, travel disruption, restricted access, or events outside reasonable control.
Drone work is subject to weather, airspace restrictions, location permissions, and legal/safety requirements.
7. Client Responsibilities
The client is responsible for providing accurate project information, access to locations, relevant permissions, agreed contributors, brand assets, scripts, product samples, interviewees, and any necessary approvals.
Where filming takes place on private property, the client must ensure permission has been granted.
Where people appear on camera, the client should ensure that contributors are aware of the filming and that appropriate permissions or releases are in place where required.
Delays caused by missing information, late feedback, unavailable contributors, or changes to the brief may affect the delivery timeline.
8. Creative Control and Final Output
Reelality Media will use professional judgement to produce work that reflects the agreed brief, brand, and creative direction.
The client may provide input and feedback during the production process. However, Reelality Media retains creative discretion over filming style, editing choices, music selection, shot selection, pacing, colour, and overall presentation unless specific requirements have been agreed in advance.
A project is considered complete once the agreed deliverables have been supplied.
9. Revisions
Unless otherwise stated in the quote, each project includes a reasonable number of revisions to the final edit.
Revisions should relate to reasonable adjustments such as text changes, minor pacing changes, music preferences, or factual corrections.
Major changes to the original brief, new creative direction, re-editing from scratch, additional versions, extra cutdowns, or requests made after approval may be charged separately.
10. Turnaround Times
Estimated turnaround times will be discussed at the start of the project. Timelines may vary depending on the size of the project, client feedback, workload, availability of assets, and the complexity of the edit.
Urgent turnaround may be available by agreement and may carry an additional fee.
A rush fee may apply where a client requires delivery within a shorter timeframe than originally agreed.
11. Ownership, Usage, and Copyright
Unless otherwise agreed in writing, Reelality Media retains copyright in the footage, photographs, edits, project files, and creative work produced.
Once full payment has been received, the client receives a licence to use the agreed final deliverables for the purposes stated in the quote. This may include website use, social media, internal use, advertising, events, presentations, or other agreed platforms.
The client may not sell, transfer, alter, re-edit, or redistribute the work outside the agreed usage without permission.
Raw footage, project files, unused photographs, editing timelines, and source materials are not included unless specifically agreed and quoted.
12. Portfolio and Promotional Use
Reelality Media may use completed work, behind-the-scenes material, stills, clips, or project references for portfolio, website, social media, showreel, award submission, or promotional purposes, unless confidentiality has been agreed in writing before the project begins.
Where a project is sensitive, confidential, embargoed, or commercially restricted, the client should notify Reelality Media in writing before production begins.
13. Music, Stock Assets, and Third-Party Materials
Where music, stock footage, fonts, images, graphics, or other third-party assets are used, they will be sourced under appropriate licences where applicable.
The client is responsible for ensuring that any materials they provide, including logos, images, footage, music, scripts, claims, trademarks, or branding, are cleared for use.
Reelality Media is not responsible for copyright issues arising from materials supplied by the client.
14. Accuracy, Claims, and Compliance
The client is responsible for checking factual accuracy, spelling, legal claims, product claims, health claims, pricing, offers, dates, locations, and regulatory compliance before final approval.
This is especially important for sectors such as food, drink, health, finance, education, public bodies, and regulated industries.
Approval of a final edit confirms that the client has reviewed and accepted the content.
15. Data Protection and Privacy
Reelality Media may collect and process basic client information such as names, email addresses, phone numbers, business details, project information, invoices, and communications in order to provide services.
Where personal data is collected, it should be handled in line with GDPR and Irish data protection law. The Data Protection Commission is Ireland’s supervisory authority for GDPR, and it advises that privacy policies should reflect how an organisation actually processes personal data and should be kept under review.
A separate Privacy Policy should be published on the Reelality Media website if personal data is collected through forms, analytics, email enquiries, cookies, newsletter sign-ups, or embedded third-party services.
16. Limitation of Liability
Reelality Media will take reasonable care in delivering professional services. However, Reelality Media is not liable for indirect losses, loss of profit, loss of business, loss of opportunity, reputational damage, or issues caused by client delay, third-party platforms, algorithm changes, technical faults, or misuse of delivered content.
Reelality Media’s total liability will not exceed the amount paid by the client for the specific project, except where liability cannot legally be limited.
17. Storage and Archiving
Reelality Media may store project files, footage, and final exports for a reasonable period after delivery, but long-term storage is not guaranteed unless agreed in writing.
Clients are responsible for downloading and safely storing their final files after delivery.
If a client requests old footage, edits, or project files after a project has been completed, retrieval, re-exporting, or re-editing may be charged separately.
18. Changes to These Terms
Reelality Media may update these Terms of Service from time to time. The terms that apply to a project will usually be the terms in place at the time the booking is confirmed, unless otherwise agreed.
19. Governing Law
These terms are governed by the laws of Ireland. Any disputes will be handled under the jurisdiction of the Irish courts, unless otherwise required by law.
